Terms and Conditions for JEC Photography

1. Ownership and Usage

1.1. Images purchased by a business from JEC Photography belong solely to that business. Other businesses wishing to use the images must purchase them directly through JEC Photography.

2. Licensing Agreements

2.1. Licence 1: Includes license for client to use images across all digital and print media, excluding magazine submissions and awards submissions, with no term limit.

2.2. Licence 2: Includes license for client to use images across all digital and print media and magazine submissions, excluding awards submissions, with no term limit.

2.3. Licence 3: Includes license for client to use images across all digital and print media, magazine submissions, and awards submissions, with no term limit.

3. Payment Terms

3.1. Payment is due within 7 days of invoice date unless otherwise stated.

3.2. No deposit is required upfront unless otherwise agreed upon.

4. Delivery Timeline

4.1. Contact sheets will be delivered within 5 days of the shoot.

4.2. Final images will be delivered within 5 days of receiving the client's selections.

4.3. Rush fees may apply for shorter timelines.

5. Cancellation Policy

5.1. A $250 callout fee applies if the client chooses not to purchase any images after the shoot has been completed.

5.2. This fee covers the photographer's time and effort, including cases where factors outside the photographer's control affect the client's decision not to purchase (e.g., site conditions).

6. Revisions and Edits

6.1. Revisions and edits can be requested at no extra charge unless otherwise stated.

6.2. Clients must request JEC Photography to complete any revisions or edits rather than doing so themselves.

7. Credit and Attribution

7.1. Please credit JEC Photography whenever and wherever possible.

8. Travel and Late Callout Fees

8.1. Travel to locations more than 50km from Melbourne CBD may incur a travel fee.

8.2. A turnaround of less than 5 days from receiving the brief to completing the shoot may incur a late callout fee.

9. Governing Law

9.1. These terms and conditions are governed by the following Australian laws:

9.1.1. Section 40 of the Australian Copyright Act 1968.

\9.1.2. Moral rights under the Australian Copyright Act 1968, including the right to be credited for work, the right not to have work falsely attributed, and the right to prevent derogatory treatment of work.

9.1.3. Privacy laws under the Privacy Act 1988, which may apply when photographing private properties or individuals in private spaces.

9.1.4. Model release forms for commercial use of photographs of individuals.

10. Rates

10.1. Half-Day Rate: $720, which includes 5 complementary images. Additional images beyond the included 5 are $30 each.

10.2. Full-Day Rate: $1440, which includes 10 complementary images. Additional images beyond the included 10 are $30 each.

11. Splitting Costs Between Multiple Clients

11.1. Splitting costs between multiple clients will be handled on a case-by-case basis.

11.2. The division of costs will depend on the number of clients involved and their specific agreements regarding the use and distribution of images.
